Terms of Use

1. Agreement

These Terms of Use ("Terms") are an agreement between you and 1000904733 Ontario Inc. ("we", "us") covering your use of the DMV Permit Prep mobile app and this website (together, the "Service"). By downloading or using the app you agree to these Terms and to our Privacy Policy. If you are under 18, a parent or guardian must agree on your behalf.

2. What the Service is (and isn't)

DMV Permit Prep is a study aid for state driver-knowledge (permit) tests. It is not affiliated with, endorsed by, or connected to any state Department of Motor Vehicles or other government agency. Official tests, rules, fees, and procedures are set by your state and may change at any time; always confirm current requirements with your state's official resources. We work hard to keep questions accurate, but we do not warrant that app content matches your official test.

3. Subscriptions and auto-renewal

• Parts of the app require a paid subscription, purchased through your Apple App Store account.
• Auto-renewal: subscriptions renew automatically at the end of each billing period at the then-current price, and your Apple account is charged within 24 hours before the current period ends, unless you cancel at least 24 hours before the period ends.
• Free trials: if your plan includes a free trial, you can cancel any time during the trial to avoid being charged. Any unused trial time is forfeited when a purchase completes.
• How to cancel: iOS Settings → your name → Subscriptions → DMV Permit Prep → Cancel. Deleting the app does not cancel a subscription.
• Refunds: App Store purchases are billed and generally refunded by Apple under Apple's policies (request at reportaproblem.apple.com). Separately, our Pass Guarantee lets you claim a refund from us if you meet its conditions.
• Prices may change; changes apply to future billing periods after notice through the App Store mechanisms.

4. Pass Guarantee

Our money-back Pass Guarantee is part of these Terms. Its eligibility conditions, claim procedure, and limits are stated on that page.

5. Acceptable use

• The app is for your personal, non-commercial use.
• Don't copy, scrape, resell, or redistribute app content (questions, explanations, images, or the mascot); don't reverse-engineer the app except where the law expressly permits it.
• Don't submit unlawful, abusive, or deceptive content through question flags or feedback.

6. Your submissions

When you flag a question or send feedback, you give us a perpetual, royalty-free license to use that submission to operate and improve the Service. Don't include personal information in submissions.

7. Intellectual property

The Service, including its content, design, and mascot, is owned by us or our licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the app on Apple-branded devices you own or control, consistent with the App Store terms.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Passing your official test depends on you — study outcomes are not guaranteed except as expressly stated in the Pass Guarantee.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Apple-specific terms

These Terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the app and is not responsible for any product claims, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

11. Termination

You can stop using the Service at any time. We may suspend or end access for breach of these Terms. Sections that by their nature should survive (intellectual property, disclaimers, liability limits) survive termination.

12. Changes to these Terms

We may update these Terms; the "Last updated" date above will change and material changes may be communicated in the app. Continued use after changes means you accept them.

13. Governing law and contact

These Terms are governed by the laws of the Province of Ontario, Canada, excluding its conflict-of-law rules. Contact: support@gopermit.org.
